The property will be conveyed by General Warranty Deed free and clear of all liens and encumbrances. The successful Buyer(s) will be required to make a deposit equal to ten per-cent (10%) of the winning bid amount in cash or approved check made payable to United Country/Frederick Auction & Realty Company and deposited with the auctioneers at the signing of the Purchase Contract. The balance of the purchase price shall be due and payable at Closing  on or before April 18, 2005 upon presentation of a deed.  Possession of the property shall be given with the delivery of the deed. The property is sold subject to all easements and restrictions of record in the Nowata County Clerks office. Seller will pay all real estate taxes for 2004 and prior years. The real estate taxes for 2005 will be prorated to the date of closing. Abstract of Title will be given to the Buyer. The cost of bringing the Abstract up to date will be a that of the Seller. The Seller will also pay for the Document Stamps on the deed. The Buyer will pay for Recording the Deed, Attorney Opinion, Title Insurance and Final Abstracting if Title Insurance is purchased, if they choose to have done. Any additional closing fees other than standard closing cost will be paid by the Buyer. Not subject to financing. If a survey is required as solely determined by the Buyer, the cost will be paid for by the Buyer.
