Terms:
The property will be conveyed by General Warranty Deed free and clear of
all liens and encumbrances. The successful Buyer(s) will be required to
make a deposit equal to ten percent (10%) of the winning bid amount in
cash or approved check made payable to United Country Frederick Auction
& Realty and deposited with the auctioneers at the signed of the Purchase
Contract. Buyer will also be required to execute a contract of Sale For
Real Estate at the conclusion of the auction, a copy of which is included
in this prospectus. The balance of the purchase price shall be due and
payable on or before August 11, 2008 upon presentation of a deed. The closing
agent will be Locke-Neosho Abstracts, Inc. of Erie, KS. Possession
of the property shall be given with the delivery of the deed. The property
is sold subject to all easements and restrictions of record in the Neosho
County Clerks office. Seller will pay all real estate taxes for 2007 and
prior years. The real estate taxes for 2008 will be prorated to the date
of closing. That proration will be based upon 2007 taxes, which were $532.12.
A Title Insurance Commitment will be given to the buyer. The cost for for
the Title Insurance Commitment will split equally (50% - 50%) between
the Seller & Buyer. Any additional closing fees other than the standard
closing cost will be paid by the Buyer. Not subject to financing. Closing
will be on or before August 11, 2008. If a survey is required as solely
determined by the Buyer, the cost will be paid for by the Buyer. Owners
interest in the mineral rights (100%) will transfer to Buyer. Sale of property
