The property will be conveyed by General Warranty Deed free and clear of all liens and encumbrances. The successful Buyer(s) will be required to make a deposit equal to ten percent (10%) of the winning bid amount in cash or approved check made payable to United Country Frederick Auction & Realty and deposited with the auctioneers at the signed of the Purchase Contract. Buyer will also be required to execute a contract of Sale For Real Estate at the conclusion of the auction. The balance of the purchase price shall be due and payable on or before December 14, 2009 upon presentation of a deed. The closing agent will be Coffeyville Title & Abstract of Coffeyville, KS. Possession of the property at closing. The property is sold subject to all easements and restrictions of record in the Montgomery County Clerks office. Seller will pay all real estate taxes for 2008 and prior years. The real estate taxes for 2009 will be prorated to the date of closing. That proration will be based upon 2008 taxes, which were $1,055.50. A Title Insurance Commitment will be given to the buyer. The cost for for the Title Insurance Commitment will split equally (50% - 50%) between the Seller & Buyer. Any additional closing fees other than the standard closing cost will be paid by the Buyer. Not subject to financing. Closing will be on or before December 14, 2009. If a survey is required as solely determined by the Buyer, the cost will be paid for by the Buyer.
